Right of Access to Personal Information
NAPS Background Checks is a consumer reporting agency as defined under
the regulations set forth in the Fair Credit
Reporting Act (FCRA) as imposed by the Federal Trade
Commission.
We understand that consumers may
be concerned about what we do with personal or
financial information. Consumers have the right to
see any information on them in the custody of NAPS and
our dispute resolution department quickly handles
all inquiries and complaints regarding information
provided to our clients. We agree consumers have a
right to know how we will utilize such information.
Therefore, we have adopted this Privacy Policy to
govern the use and handling of personal information.
Notice
NAPS, Inc. collects information on individuals for
the purpose of providing the information to
landlords for tenant related decisions and employers
for employment related decisions (hire, retain,
promote, assign or reassign). Prior to receiving
information from NAPS, Inc., each landlord or
employer must provide a certification (as prescribed
the Fair Credit Reporting Act) that it will only use
the information for tenant or employment purposes
and that it will comply with all local, state and
federal regulations and obligations. Information may
also be utilized to conduct employee investigations
where an employer has a suspicion of work related
misconduct or wrongdoing and only human resources
and security professionals within the employer
organizations will utilize the information.
Use of Personal Information - Privacy
As a corporation specializing in tenant/employment
screening, the Fair Credit Reporting Act requires
that extremely sensitive and personal information
about individuals be kept confidential. Under no
circumstances will the personal information
collected and maintained in our databases ever be
sold or provided to an outside entity for any
purpose. NAPS, Inc. does not use our databases of
applicant information to compile mailing lists for
sales or any other purpose. We provide
tenant/employment-screening services only to
businesses with a permissible purpose. We release
information via telephone, fax, mail and electronic
transmittal, only to the individual or business that
originally requested the service.
Consumer Confidentiality and Security
Under penalty of law and in accordance with the Fair
Credit Reporting Act (FCRA 15 U.S.C. § 1681r], NAPS,
Inc. does not share, disclose, or sell any
information to unauthorized parties. NAPS, Inc.
respects the privacy interests of all clients,
consumers, and visitors to our web sites. Be assured
that we take extreme caution in protecting the
privacy of this information. Additionally, NAPS,
Inc. is committed to safeguarding and securing our
methods of data transmission. Personal information is processed only with the
consumer’s knowledge and authorization. Only
information that is actually needed is collected and
processed. Our employees are screened and trained to
ensure that information is handled responsibly and
in accordance with the Privacy Policy. We maintain
strict physical, electronic, and routine safeguards
that comply with state and federal regulations to
guard a consumer’s nonpublic and public personal
information. Personal information is protected from
unauthorized or accidental disclosure and is only
seen by those persons who need it to perform their
job to provide the products and services authorized
by you. Personal information is retained only as
long as is required by law. Data Integrity
The data collected includes information, which is
necessary to identify the consumer for purposes of
collecting tenant or employment related information.
NAPS, Inc. makes every reasonable effort to assure
maximum possible accuracy in the information
collected. NAPS, Inc. maintains strict procedures,
regarding public record information that is likely
to have an adverse effect on the consumer, to ensure
the information is complete and up to date per FCRA
rule 613 (a)(1)(2). NAPS, Inc. cannot be responsible
for errors within court records, records of other
consumer reporting agencies, such as credit bureaus,
customer data entry errors and electronic
transmission errors due to interruptions caused by
acts of God. Therefore, NAPS, Inc. cannot act as a
guarantor of information. Security
NAPS, Inc. takes all reasonable procedures to
protect personal and identifiable information from
loss, misuse, and unauthorized access, disclosure,
alteration, and destruction. NAPS, Inc. utilizes a
128-bit encryption on an off-site secured server for
all Internet communications. Furthermore, only NAPS,
Inc. employees who need the information to perform a
specific job are granted access to personally
identifiable information. Strong password protection
protocols are used on all computers. All employees
are kept up-to-date on our security and privacy
policies. Servers, which are used to store
personally identifiable information are kept in a
secure environment, with appropriate security
measures. NAPS, Inc. has received “Site Secure
Certification” through IdAuthority™ Corporation.
These measures ensure personal information will be
available only to those with a right to know.
Third Party Transfer
The information obtained, collected and compiled by
NAPS, Inc. is forwarded only to an entity that has
been specifically authorized by the consumer to
receive the data, or an agent of the end-user
operating on behalf of the end-user, and only for
the permissible purpose described under the “Fair
Credit Reporting Act”. NAPS, Inc. takes reasonable
steps to ensure that any party that receives
information will maintain privacy and
confidentiality. Any third party, which receives
information from NAPS, Inc. has received written
authorization from the consumer, and has given the
consumer prior notice as to the purpose of the
collection of data. Each transfer of information to
the third party includes a privacy and confidential
use of the information notice.

General information may be collected when you visit
our web site, including your domain name, the name
of the web page from which you entered our site,
which pages you visit on our site, and how much time
you spend on each page. This information does not
include specific identifying information about you.
We may only use this information to monitor and
improve our site, and we will not provide this
information to outside parties.
